Lakeway Municipal Utility District Board Passes Resolution Regarding Kay Andrews


LAKEWAY, Texas—The Board of Directors of the Lakeway Municipal Utility District approved a resolution Wednesday, Aug. 19, requesting that Board member Kay Andrews abide by certain provisions of the Board’s Duties & Responsibilities Policy and that she stop defaming the District’s General Manager.

The resolution was passed during the Board’s regularly monthly meeting. Approval of the resolution followed a public hearing on a complaint against Andrews filed by Richard Eason, General Manager of the District. The complaint alleged numerous violations by Andrews of the Board’s Code of Ethics Policy and the Board’s Duties & Responsibilities Policy.

The Board-approved resolution asks Andrews to:

  • Follow the provision of the Duties & Responsibilities Policy stating that Board directors, other than the Board president, will have direct communication and contact with suppliers, vendors, consultants and advisers only during Board meetings, or as directed by the full Board. The resolution requests that Andrews not communicate with the District’s suppliers, vendors, consultants and advisers except during Board meetings.
  • Follow the provisions of the Duties & Responsibilities Policy stating that a Board director’s contact with the staff should occur only during Board meetings, and that contact with staff outside Board meetings should be done only through the District’s general manager. The resolution requests that Andrews not contact staff outside Board meetings except through the District’s general manager.
  • Cease making an array of allegations against Eason; the allegations were outlined in the complaint filed by Eason. The resolution requests that she stop defaming the District’s General Manager.


The complaint that the Board considered Aug. 19 was based on actions and statements by Andrews that violated the Board’s Code of Ethics Policy and the Board’s Duties & Responsibilities Policy.

Section 49.199 of the Texas Water Code requires the Lakeway Municipal Utility District to adopt a code of ethics. In August 2006, Andrews made the motion to approve the Board’s code of ethics; the code was passed unanimously. Meanwhile, Section 49.057 of the Texas Water Code authorizes the Board to adopt bylaws; in the case of the Lakeway Municipal Utility District, the bylaws are contained in the Board’s Duties & Responsibilities Policy.
